OVERVIEW

This website, www.maidocustoms.com, is operated by Maido Customs. Throughout the site, the terms “we”, “us” and “our” refer to Maido Customs.

By accessing this website, browsing our products, creating an account, contacting us, or placing an order, you agree to be bound by these Terms of Service, together with any policies referred to on this website, including our Privacy Policy, Shipping Policy and Returns Policy.

Please read these Terms carefully before using our website. If you do not agree with these Terms, you should not use this website or purchase products from us.

Maido Customs operates exclusively as an online store. We do not currently operate a public showroom, retail shopfront or walk-in collection facility unless expressly stated by us in writing.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot be excluded, restricted or modified by agreement. Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

We may update, change or replace any part of these Terms by posting updates to this page. Your continued use of the website after changes are posted means you accept those changes.

SECTION 1 - ONLINE STORE TERMS

By using this website, you confirm that you are at least the age of majority in your state, territory or country of residence, or that you are using the website with the consent of a parent or legal guardian.

You must not use our website, products or services for any illegal, unauthorised or unsafe purpose. You must not transmit viruses, malware, worms, malicious code or anything else that may damage, interfere with or compromise the operation of the website.

A breach of these Terms may result in the immediate suspension or termination of your access to our website or services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service, cancel orders, restrict access, or limit sales where we reasonably believe it is necessary to protect our business, customers, suppliers, website, payment systems or legal obligations.

You agree not to reproduce, duplicate, copy, sell, resell, exploit or misuse any part of the website, its content, product information, images, design, systems, or services without our written permission.

Payment information may be processed by secure third-party payment providers. We do not ask customers to send full card details by email or message.

SECTION 3 - ACCURACY OF INFORMATION

We try to ensure that product information, pricing, specifications, images, availability, shipping information and website content are accurate and up to date.

However, occasional errors, inaccuracies or omissions may occur. We reserve the right to correct errors, update information, change product details, change pricing, or cancel an order affected by an error, including after an order has been submitted.

Where an order is cancelled due to an error and payment has already been made, we will arrange a refund of the amount paid for the cancelled item or order.

SECTION 4 - MODIFICATIONS TO PRODUCTS, SERVICES AND PRICES

Prices for our products may change without notice. We may modify, discontinue, update or remove products, services, website content, promotions or offers at any time.

We are not liable to you or any third party for any modification, price change, suspension, discontinuance, or unavailability of any product, service or part of the website, except where required by law.

SECTION 5 - PRODUCTS, AVAILABILITY AND ONLINE SALES

Certain products may be available exclusively online and may have limited quantities. Product availability is not guaranteed until your order has been accepted and processed.

We reserve the right to limit the sale of products to any person, geographic region or jurisdiction where necessary or appropriate. We may limit quantities purchased per person, per household, per account, per payment method, or per order.

Product descriptions, specifications and prices may change at any time without notice.

Any offer made on this website is void where prohibited by law.

SECTION 6 - PRODUCT IMAGES, COLOURS AND VARIATIONS

We make every effort to display product images, colours, finishes and details as accurately as possible. However, product appearance may vary depending on lighting, screen settings, photography conditions, production method and vehicle setup.

For carbon fibre, body kit, aerodynamic, hand-finished, painted, made-to-order or custom-made products, minor variations may occur. These can include differences in colour shade, gloss, weave appearance, reflections, texture, trim lines, fitment tolerance or finish.

Major differences, faults, damage or defects should be reported to us promptly so we can assess the issue and assist with a suitable resolution.

SECTION 7 - CUSTOM-MADE, SPECIAL-ORDER AND PRE-ORDER PRODUCTS

Custom-made, special-order, pre-order, painted, carbon fibre, made-to-order or personalised products are generally not eligible for change-of-mind returns, refunds or store credits once production, ordering or processing has commenced.

Custom-made or special-order items may only be cancelled within 1 hour of placing the order, unless production, ordering, supplier processing or fulfilment has already commenced.

Custom-made products usually take approximately 2 to 3 weeks before shipment, unless a different timeframe is stated on the product page or advised by us. In some cases, production or dispatch may take up to 6 weeks or longer due to supplier delays, customs delays, production queues, freight delays, public holidays or circumstances outside our control.

If we need further information from you to complete an order, you agree to respond promptly. If we are waiting for your response, production, dispatch and shipping timeframes may be paused until the required information is provided.

This section does not affect your rights under the Australian Consumer Law if a product is faulty, not as described, not fit for purpose, or otherwise fails to meet a consumer guarantee.

SECTION 8 - IN-STOCK ORDERS AND CANCELLATIONS

Orders for in-stock items may be cancelled within 24 hours of placing the order, provided the order has not already been packed, dispatched, collected by a courier, specially allocated, or otherwise processed for shipment.

Once an order has been packed, dispatched or processed for shipment, it cannot usually be cancelled. You may still contact us to request assistance, and any available options will be assessed on a case-by-case basis.

This does not affect your rights under the Australian Consumer Law.

SECTION 9 - ORDER ACCEPTANCE, BILLING AND ACCOUNT INFORMATION

When you place an order, you agree to provide current, complete and accurate billing, shipping, contact and account information.

We may refuse, limit, hold, cancel or request verification for an order if we reasonably believe the order contains incorrect information, appears fraudulent, appears to be placed by an unauthorised reseller, contains a pricing or stock error, or cannot be fulfilled.

If we change or cancel an order, we may attempt to notify you using the email address, phone number or billing details provided at the time of order.

You agree to promptly update your account and contact information so we can complete your transactions and contact you where needed.

SECTION 10 - PAYMENT, FRAUD AND SECURITY

You must ensure that any payment method used for an order is authorised and lawful.

Maido Customs may cooperate with banks, payment providers, courier companies and law enforcement authorities where we reasonably suspect fraudulent, unauthorised or unlawful use of a payment method, account, identity, shipping address or billing address.

We reserve the right to cancel, hold or request further verification for any order that appears suspicious or high risk.

SECTION 11 - SHIPPING, DELIVERY AND INTERNATIONAL ORDERS

Delivery times are estimates only and may vary due to courier delays, customs processing, supplier delays, production delays, public holidays, peak periods, weather, international freight delays or circumstances outside our control.

If your order is delayed, missing, damaged in transit, or appears to have been delivered incorrectly, please contact Maido Customs first so we can investigate with the courier and assist with a suitable resolution.

Please keep all packaging and take clear photos of any damage, as these may be required for courier investigation, insurance or claim purposes.

For international orders, you are responsible for any customs duties, import taxes, local charges, clearance fees or other costs charged by authorities in the destination country, unless expressly stated otherwise at checkout.

This section does not limit any rights you may have under the Australian Consumer Law or other applicable law.

SECTION 12 - PRODUCT FITMENT AND CUSTOMER RESPONSIBILITY

Customers are responsible for checking product compatibility, vehicle model, year, variant, body shape, trim, specifications and fitment information before placing an order.

Where fitment information, filters, product notes or compatibility information are provided on the website, you should review them carefully before purchase. If you are unsure whether a product is suitable for your vehicle, you should contact us before placing an order.

Body kits, splitters, spoilers, diffusers, grilles, carbon fibre parts and other aftermarket automotive accessories may require professional fitting, adjustment, trimming, preparation or test fitting before final installation or painting.

You should test fit products before painting, drilling, modifying, bonding or permanently installing them.

This section does not affect your rights if we supply an incorrect item, the product does not match its description, or the product fails to meet a consumer guarantee.

SECTION 13 - INSTALLATION, MODIFICATION AND USE

Maido Customs is not responsible for damage caused by incorrect installation, poor handling, misuse, modification, improper storage, third-party installation, vehicle differences, painting, drilling, cutting, bonding, force-fitting, or failure to test fit before installation.

We strongly recommend professional installation for body kits, carbon fibre parts, spoilers, splitters, diffusers, grilles and other automotive accessories.

Once a product has been installed, painted, modified, drilled, bonded, damaged, used or tampered with, it may not be eligible for a change-of-mind return.

This does not affect your rights where the product itself is faulty or does not meet a consumer guarantee.

SECTION 14 - RETURNS, REFUNDS AND AUSTRALIAN CONSUMER LAW

Your rights under the Australian Consumer Law are not limited by these Terms.

If a product fails to meet a consumer guarantee, you may be entitled to a remedy such as a repair, replacement, refund or compensation, depending on the circumstances and whether the failure is major or minor.

For change-of-mind returns that we choose to approve, products must be unused, uninstalled, unpainted, unmodified, undamaged and returned in original packaging where possible.

Change-of-mind returns are not automatically available for custom-made, special-order, made-to-order, personalised, painted, carbon fibre or pre-order products.

Returns must be approved by Maido Customs before being sent back. Please contact us first and wait for return instructions before shipping any item back to us.

Where we approve a change-of-mind return, a restocking fee of up to 25% may apply. Any applicable fee will be advised before the return is accepted.

A restocking fee will not apply where you are entitled to a remedy under the Australian Consumer Law.

SECTION 15 - DAMAGED, FAULTY OR INCORRECT ITEMS

If you believe your item has arrived damaged, faulty, incorrect, incomplete or not as described, please contact us as soon as possible with your order number, a clear description of the issue, and photos or videos showing the product, packaging and any damage.

Please do not install, paint, modify or use a product that you believe is faulty, damaged or incorrect before contacting us, as this may make it harder to assess the issue.

We will assess the issue and assist with a suitable resolution in accordance with your rights under the Australian Consumer Law and any applicable warranty.

SECTION 16 - WARRANTIES

Some products may include a manufacturer, supplier or express warranty. Warranty terms may vary depending on the product, supplier and manufacturer.

Warranties are in addition to, and do not replace, your rights under the Australian Consumer Law.

Warranty claims may require proof of purchase, photos, videos, inspection, return of the item, supplier assessment or manufacturer assessment.

Damage caused by incorrect installation, misuse, accident, modification, poor handling, normal wear and tear, track use, racing use, improper storage or third-party work may not be covered by warranty.

SECTION 17 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to third-party tools, apps, payment providers, shipping providers, review systems, tracking systems or other services that we do not control.

You acknowledge that third-party tools and services may be subject to their own terms, privacy policies and operating conditions.

We are not responsible for third-party services except to the extent required by law.

SECTION 18 - THIRD-PARTY LINKS

Our website may contain links to third-party websites, services or resources. These links are provided for convenience only.

We are not responsible for examining, evaluating or guaranteeing the content, accuracy, policies, products, services or practices of third-party websites.

Any dealings with third-party websites are at your own risk and should be reviewed carefully before you proceed.

SECTION 19 - USER COMMENTS, REVIEWS, FEEDBACK AND SUBMISSIONS

If you send us comments, reviews, photos, videos, feedback, suggestions, ideas or other submissions, you agree that we may use, edit, publish, reproduce, display or distribute them for business, marketing, product improvement or customer service purposes, unless you clearly tell us otherwise in writing.

You agree that your submissions will not violate any third-party rights, including copyright, trademark, privacy, confidentiality or personal rights.

You must not submit unlawful, abusive, misleading, defamatory, obscene, threatening, offensive or harmful content, or content containing viruses or malware.

We may monitor, edit, refuse or remove content at our discretion.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.

To the maximum extent permitted by law, Maido Customs and its owners, directors, employees, contractors, suppliers, service providers and affiliates will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of revenue, loss of data, replacement costs, or similar losses arising from your use of the website or products, except where such liability cannot be excluded by law.

SECTION 24 - INDEMNIFICATION

To the maximum extent permitted by law, you agree to indemnify and hold harmless Maido Customs and its owners, directors, employees, contractors, suppliers, service providers and affiliates from any claim, demand, loss, damage, cost or expense arising from your breach of these Terms, misuse of the website, violation of any law, or infringement of the rights of a third party.

SECTION 25 - SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and any unenforceable part will be treated as severed from these Terms.

The remaining provisions will continue in full force and effect.

SECTION 26 - TERMINATION

These Terms remain effective unless terminated by either you or us.

You may terminate these Terms by ceasing to use the website.

We may terminate or restrict your access if we believe you have breached these Terms or used the website in an unlawful, harmful or improper way.

Any obligations and liabilities incurred before termination will survive termination where appropriate.

SECTION 30 - IMPORTANT TERMS ACCEPTED AT TIME OF ORDER

By placing an order at www.maidocustoms.com, you acknowledge and agree that:

  1. Custom-made, special-order, pre-order, painted, carbon fibre, made-to-order or personalised products are generally not eligible for change-of-mind returns, refunds or store credits once production, ordering or processing has commenced.
  2. Custom-made or special-order items may only be cancelled within 1 hour of placing the order, unless production, ordering, supplier processing or fulfilment has already commenced.
  3. In-stock items may only be cancelled within 24 hours of placing the order, provided the order has not already been packed, dispatched, collected by a courier, specially allocated, or otherwise processed for shipment.
  4. Change-of-mind returns will not usually be accepted for products that have been opened, installed, painted, modified, drilled, bonded, tampered with, used or damaged.
  5. You are responsible for checking vehicle model, year, variant, body shape, trim, specifications and fitment information before ordering.
  6. Maido Customs is not responsible for damage caused by incorrect installation, third-party installation, misuse, modification, painting, drilling, cutting, bonding, poor handling or failure to test fit before installation.
  7. Product images are provided as accurately as possible, but colours, finishes, reflections, carbon fibre weave, texture and appearance may vary due to lighting, screen settings, production method and vehicle setup.
  8. Custom-made products usually take approximately 2 to 3 weeks before shipment, but in some cases may take up to 6 weeks or longer due to supplier delays, production delays, freight delays, customs processing or circumstances outside our control.
  9. If we require information from you to complete an order and you do not respond promptly, production and shipping timeframes may be delayed or paused.
  10. If your order is delayed, missing, damaged in transit, or appears to have been delivered incorrectly, you should contact Maido Customs first so we can investigate with the courier and assist with a suitable resolution.
  11. Nothing in this section limits your rights under the Australian Consumer Law.
